These General Terms and Conditions govern access to the website www.manuelashala.com (“Site”), as well as the purchase and use of the products, services, and information contained or marketed on the Site (“General Terms and Conditions”).

Any person who intends to purchase products or services on the Site (“User”) or, furthermore, have access to the information provided on the therapists who have attended the Manuela Shala®️ LinfoModellante Method course (“Therapists”) must ensure that they have understood and accepted the General Terms and Conditions of Use of the Site.

We recommend that you carefully read and ensure that you understand and accept all the conditions set forth in these General Terms and Conditions before completing your registration as a User and/or making any purchase or search through the site.

1. SUBJECT

1.1. These General Terms and Conditions govern access to the Site, in particular (i) the provision of general information on activities, events, products, and preparatory courses relating to the group composed of Metodo LinfoModellante®️ by Manuela Shala®️ Manuela Shala Group KFT., herein referred to as Metodo LinfoModellante®️ by Manuela Shala®️; (ii) the User's access to and use of the information available on the Site regarding the Therapists who have attended the Metodo LinfoModellante®️ by Manuela Shala®️ , and (iii) the dissemination, sale, and purchase of Metodo LinfoModellante®️ by Manuela Shala®️ (“Products” and “Services”).

1.2. The User acknowledges and agrees that information about individuals who have attended the Manuela Shala Method course is made available on the Site for informational purposes only, for the User's optional use, at their sole discretion and under their responsibility. Manuela Shala®'s LinfoModellante® Method does not represent or assume responsibility for the skills or licensing status of any individuals listed on the Site. The User must independently verify whether the individual holds all necessary licenses to provide massage services in their jurisdiction and conduct their own due diligence before agreeing to receive any services. Any contact or negotiations with any individuals listed on the Site will be made directly by the User, without any involvement of Manuela Shala®'s LinfoModellante® Method in the contact, negotiation, contract, and actual hiring and/or provision of any services. There is no employment or other relationship of any kind between the individuals listed on the Site and the Manuela Shala® LinfoModellante® Method.

1.3. The conditions of sale of the products and services advertised on the site are described in these General Terms and Conditions and on the page of the respective product or service advertisement.

1.4. The User will receive information about the purchase and delivery status of the Products via email, SMS, or WhatsApp. By accepting these General Terms and Conditions, the User authorizes the Manuela Shala® LinfoModellante® Method to send emails, SMS, and WhatsApp messages with information about the purchase and delivery status of the order to the email address and mobile phone number provided by the User during registration.

1.5. Metodo LinfoModellante® may make available, at its sole discretion, User testimonials about the Products and Services available on the Site. The User expressly authorizes the disclosure, on the Site, of his or her testimonials regarding the Products and Services, delivery times, assistance received, and other aspects of the relationship between the User and Manuela Shala®'s Metodo LinfoModellante®.

1.6. The User is aware and agrees that the Manuela Shala® LinfoModellante® Method will have no responsibility for the testimonials left by Users, which will be made available on the Site in order to share data on the Users' experiences, and should not be interpreted as any type of guarantee by the Manuela Shala® LinfoModellante® Method.

2. USER REGISTRATION AND ACCESS TO THE SITE

2.1. The purchase of Products or Services available on the Site may only be made by persons over 18 (eighteen) years of age who have the legal capacity to contract, a valid email address, and who complete the mandatory registration fields.

2.2. In addition to persons considered legally incapacitated, Users whose accounts have been deleted from the Site due to violation of these General Terms and Conditions will not be able to purchase Products or Services.

2.3. Each User registration is unique; the same person is not permitted to have more than one registration on the Site. Manuela Shala's LinfoModellante® Method® reserves the right to refuse or cancel any registration that does not comply with these General Terms and Conditions.

2.4. To register, the User must fill out all registration data fields with accurate, complete, and truthful information. It is their responsibility to update such information whenever changes occur. Registration will be completed only after the User declares that they have read, understood, and accepted these General Terms and Conditions.

2.5. Any changes to User data must be communicated immediately to the following email address: info@manuelashala.com, by the User himself/herself, by updating his/her registration data on the Manuela Shala® LinfoModellante Method. Users will be solely and exclusively responsible for any damages or losses caused to themselves, third parties, or the MS method due to the omission, inaccuracy, or falsity of the information provided during their registration on the Site, as well as for any delay in updating or modifying their registration data.

2.6. RESPONSIBILITY FOR USE OF USER REGISTRATION. The User is aware and voluntarily and expressly accepts that the User's registration is personal and non-transferable, and that use of the Site will always be via login and password, under the User's sole and exclusive responsibility, and must keep their login and password secure. The User will be solely and exclusively responsible for the use and transactions performed using their login and password, and undertakes to immediately notify MS of any suspected unauthorized access to their User registration by sending an email to info@manuelashala.com. The User understands that, in such case, the site may block or suspend the User's registration for the period necessary to verify the suspected unauthorized access.

2.7. The content of the information entered during registration is the sole responsibility of the User, and the Site is not responsible for correcting or verifying Users' personal data or for any consequences arising from the User's provision of incorrect or false data.

2.8. Notwithstanding the provisions of point 2.6 above, the Manuela Shala® LinfoModellante® Method reserves the right to verify the accuracy of the User's registration data and to request additional information or documents it deems necessary to confirm the data provided.

2.8.1. If the staff finds that the User has provided incorrect or false data, they may, at their sole discretion, block, suspend, or cancel the User's registration.

2.9. REQUEST TO DELETE REGISTRATION. The User may, at any time, request deletion of their registration on the Site. To do so, the User must send a message to Info@manuelashala.com. Manuela Shala®'s Metodo LinfoModellante®will verify, within 30 (thirty) business days, whether there are any pending purchase transactions (not yet completed) in the User's account. If there are no pending purchase transactions or outstanding payments of amounts due to Manuela Shala®'s Metodo LinfoModellante® as set forth in these General Terms and Conditions, the Site will proceed to delete the User's registration at the end of the 30 (thirty) business day period. If there are any pending (unfinished) purchase transactions or pending payments of amounts due to the Manuela Shala® LinfoModellante® Method, as set forth in these General Terms and Conditions, the Site will delete the User's registration within 30 (thirty) business days from the date the last purchase transaction is completed or the outstanding amount is paid. In any case, the Manuela Shala® LinfoModellante® Method will retain information on transactions carried out by the User for a period of 6 (six) months, or for a longer period if required by applicable law.

2.10. Registration on the Site is free. However, the products and services offered by the Site will be charged as set forth on the Site and in these General Terms and Conditions, based on the Product or Service purchased by the User.

3. RELATIONSHIP BETWEEN USER AND THERAPIST

3.1. The User acknowledges and agrees that the Site does not market the massage services offered by Therapists, but merely provides a tool to assist the User in finding therapists. Furthermore, the services require advance booking made directly with the Therapist, subject to availability for the desired date, exempting the Metodo LinfoModellante® by Manuela Shala® from any financial liability, with the calendar or information relating to the Therapists and published on the Site. We recommend that the User verify the information and book in advance.

4. PRICE AND PAYMENT METHODS

4.1. The payment methods accepted for the purchase and sale of Products or Services carried out on the Site will follow the form described on the Site at the time of completion of the purchase.

4.2. The order for the purchase of Products or Services will be processed when Manuela Shala® LinfoModellante Method receives confirmation of payment.

4.3. The price of each Product or Service is the one specified on the site at the time the order is placed and includes all taxes. The price will be increased only by shipping costs, where applicable, related to delivery of the product to the address provided by the User in the relevant order.

5. EXCHANGE AND RETURN POLICY

5.1. To protect your safety, we adopt an Exchange and Return Policy based on the Consumer Code, ensuring that your rights are respected.

5.2. Check your order. When placing your order, it's important to check whether the features and description of the Service or Product you've chosen match the product you wish to purchase and to fill out the required information correctly when completing the purchase. Also check that your details are correct.

5.3. Withdrawal/Termination of Service. The User has up to 14 (fourteen) calendar days from the date of purchase to communicate their withdrawal from the Service, provided that the Service has not yet been provided. In this case, the User will receive a refund of the amount paid as described in section 5.5. "Refund of the Amount Paid." Please note this deadline, as requests made after this deadline will not be accepted. To make your request, contact our Help Center by email at info@manuelashala.com

5.4. Product withdrawal/cancellation. The User has up to 14 (fourteen) calendar days, starting from the date of receipt of the Product, to communicate the withdrawal from the purchase with the certainty of receiving a refund of the amount paid, including shipping costs. Please note this deadline, as requests outside this deadline will not be accepted. To make your request, contact our Help Center via email at info@manuelashala.com.

5.4.1. Product returns for withdrawal can only be made upon presentation of the invoice. Furthermore, the Product must be in its original packaging, with the manufacturer's seal intact, free of signs of use, and in perfect condition.

5.4.2. If any discrepancies or damaged packaging are found, we reserve the right to refuse the return and not refund the amount paid, and may return the product to the user without prior consultation. Therefore, for your added security, please ensure that the product you receive meets your expectations before tampering with the packaging.

5.5. Refund of the amount paid. The refund of the amount paid for Services not yet started, or in the event of withdrawal or termination, will be made only after receipt and analysis of the conditions of the returned Product(s), as follows:

a. Refund of the Product amount, including shipping costs, for purchases paid by credit card or other payment platforms that use credit card debit. In this case, it is important to note that the refund will be made in a maximum of two successive installments, being the responsibility of your credit card administrator; and

b. Deposit into the current account indicated by you within 10 (ten) working days of formalizing the withdrawal request, for purchases paid by bank transfer or account deposit.

5.6. Damaged Product. If the User identifies a defect or fault in the Product, he or she must contact our Customer Service Center via email at info@manuelashala.com within 30 (thirty) calendar days of receiving the Product, pursuant to Article 26, I, of the Consumer Code.

5.6.1. In this case, the exchange will be processed only after receipt and inspection of the returned Product(s). If the Product is found to be free of any flaws or defects or signs of misuse or improper storage, Manuela Shala's Metodo LinfoModellante®️ may refuse the exchange and return the Product to the User.

5.6.2. In this case, the product must be returned with the invoice, specifying the reason for the return. Failure to include the invoice will prevent the order from being identified and, consequently, the exchange.

5.6.3. Our support team will analyze your request and respond to your complaint within a maximum of 30 (thirty) calendar days, starting from the date of receipt of your product at the Manuela Shala® LinfoModellante Method®

5.7. Important: I clarify that all Products sent by Metodo LinfoModellante® by Manuela Shala® due to a defect will undergo a preliminary technical analysis to verify the existence of a manufacturing defect. An exchange or refund will not be due if the absence of the defect or any sign of misuse or storage of the product is found. In the event of a defect, we will contact you to take appropriate action to resolve the identified issue.

6. TERM AND MODIFICATION OF THE GENERAL TERMS AND CONDITIONS

6.1. These General Terms and Conditions come into force on the date of their publication on the Site and will remain valid for an indefinite period or until they are replaced by a new version of these General Terms and Conditions. (26/07/2021)

6.2. Manuela Shala®'s LinfoModellante® Method may , at any time, modify these General Terms and Conditions, replacing them with new general terms and conditions that will come into effect from the date of their publication on the Site and will apply to purchase and sale transactions and searches initiated from the date of their publication on the Site.

7. PRIVACY POLICY

7.1. Your privacy is important to us. All personal information or data provided by the User is stored on highly secure servers or magnetic media. Manuela Shala's LinfoModellante® Method will take all possible measures to maintain the confidentiality and security of the information described in this clause, but will not be liable for damages resulting from the violation of such measures by third parties using public networks or the Internet, subverting security systems to access User information.

7.2. Personal data we collect. We collect User data through our interactions with Users and through our Site for the purposes described below, particularly to operate efficiently and provide the best experiences with our Products and Services. Some of this data is provided directly by the User.

7.2.1. The data we collect may include:

• Name and contact information. Your first and last name, email address, address, telephone number, and other similar contact information;
• Credentials. Passwords, password hints, and similar security information used to access your registration on the Site;
• Demographic data. Data about you, such as your age, gender, country/region, state, and city;
• Payment data. Payment processing data, such as your payment method number (e.g., a credit card number) and the security code associated with your payment method. This data is collected by the Site but is not stored by the site, being transmitted via a secure environment (SSL) to the payment gateway, a third-party company that processes the payment transactions with banks;
• Purchase history. Data on the Products and Services purchased by the User on the Site;

By accepting these General Terms and Conditions, the User agrees to receive newsletters informing them of the Manuela Shala® Method LinfoModellante® and/or promotional communications from our Site via email, SMS, WhatsApp, postal mail, and telephone. The User acknowledges that, in such cases, we may use the data collected to provide such promotional communications. If the User receives promotional communications and wishes to no longer receive them, he or she may unsubscribe by following the instructions contained in the message.

7.4. Data Sharing. Your personal data may be shared with your prior authorization or as necessary to complete any transaction or provide a specific Product or Service purchased by you. For example, payment information provided by you to make a purchase may be shared with banks and other entities that process payment transactions or provide other financial services, for fraud prevention and credit risk reduction. Personal data may also be shared with the Site's partners and service providers involved in providing the Product or Service purchased by you or in providing customer support (for example, companies engaged in customer service). Furthermore, personal data may be shared to comply with the law or respond to legal proceedings, including those from government authorities or entities. 7.7. User Access to Personal Data. The User may access and control the personal data obtained from the Site. In the case of data obtained with the User's consent, the User may revoke this consent at any time by contacting us at info@manuelashala.com .Furthermore, the User may request access, updating, or permanent deletion of their personal data by contacting us at info@manuelashala.com. Requests for access and control of personal data will be responded to within a maximum of 30 days.

7.7.1. At any time, the User may request the permanent deletion of his/her registration data or the cancellation of his/her registration, without prejudice to the retention hypotheses required by law, including any ratings, comments and tax information of the User.

7.7.2. Information will not be subject to confidentiality if (i) it was already in the public domain at the time of its receipt or becomes public domain without breach of the obligations assumed in this agreement; (ii) it comes to the knowledge of the parties in a non-confidential manner, received from third parties, the acquisition and disclosure of which occurred in a completely independent manner, without breach of any of the obligations assumed in this agreement and without any confidential nature; and (iii) the disclosure of which is required by law, regulations or administrative, judicial or arbitral decisions.

7.7.3. The User expressly authorizes the collection, storage, processing, use, management, and sharing of his or her personal information and data with the Metodo LinfoModellante®️ by Manuela Shala®️ and other companies involved in the provision of services or the supply of products pursuant to these General Terms and Conditions, in order to enable the provision of services, the supply of products, and the execution of purchase and sales transactions, including the delivery of the Products.

8. GENERAL CONDITIONS AND LIMITATION OF LIABILITY

8.1. Cases omitted in these General Terms and Conditions will be resolved by Manuela Shala's Metodo LinfoModellante® in collaboration with the User.

8.2. Failure by either party to comply with any provision of these Terms and Conditions shall not be construed as a waiver or novation.

8.3. The User declares to be aware and agrees that the Manuela Shala® LinfoModellante® Method will not be liable, under any circumstances, for compensation for indirect damages or lost profits.

8.4. The information about the therapists registered on the Site is provided by the therapists themselves. Manuela Shala's LinfoModellante® Method responsible for validating and/or verifying the information provided by the therapists. Users are advised to verify and confirm the information provided by the therapists.

9. Copyright, trademark and patent registration, prohibition of training.

Manuela Shala® and LinfoModellante® are registered trademarks with the relevant authorities. Unauthorized use of these trademarks constitutes a serious intellectual property infringement.

The LinfoModellante® method conceived and created by Manuela Shala® was born as an aesthetic treatment based on the use of hands and oil.

Manuela Shala's LinfoModellante® protocol is based on unique cardinal points (points of orientation). The MS® protocol was created to treat individual areas of the body.

Areas intended for the abdomen, legs, and face. Each Manuela Shala method session lasts 50 minutes and cannot be customized for any reason. Any changes to the schedule constitute a serious violation of the protocol and the integrity of the brand.

The protocol on this site may not be violated in any way. All steps, timing, and procedures have been designed to ensure 100% quality treatment. Failure to follow the protocol will result in serious trademark infringement and subsequent patient and/or client dissatisfaction.

The Manuela Shala Lymphomodeling method, intended as a treatment, is intended for all HEALTHY individuals. A Manuela Shala therapist cannot, in any way, replace competent and relevant professionals, under penalty of violating the civil and criminal laws of the country in question.

Each therapist is advised to draft an informed consent form to present to the client and, before starting treatment, to ensure that the patient/client does not have any of the pathologies or conditions listed in the document included in this volume.

The Manuela Shala LinfoModellante® method was created to provide general well-being without the use of machinery, drugs, cosmetics, or tools of any kind. For this reason, merging, mixing, or combining techniques external to the treatment is strictly prohibited. Failure to do so will result in the brand's exclusion from liability and a serious violation of the Manuela Shala LinfoModellante® brand protocol.

Images, logos, sounds, photos, and videos are the intellectual property of the Manuela Shala® brand. Unauthorized use will constitute trademark infringement with civil and criminal consequences.

The "Find Your Therapist" section of the www.manuelashala.com website is subject to restrictions and limitations as described by the trademark owner.

The owner of the Manuela Shala® and LinfoModellante® brands reserves the right to include names of therapists on its website. Requests must be submitted using the following methods:

The request must be sent to the following number +39 351 669 6511 via WhatsApp.

The request must include your name, company name, full address (street, city, zip code, country), telephone number, email address, link to your Instagram account, and a logo or photo (450x450px).

The trademark owner may approve or deny the request without having to provide reasons.

For those already registered on the www.manuelashala.com website, find your therapist section, we strongly recommend following these guidelines: Apply a minimum price of €120 per area (abdomen, legs, face, arms) and a 50-minute session. Note: The price can be increased, but never decreased, by €120

Do not discount the total of any packages or programs by more than 20%. For example, a 10-session package costing €1200 cannot be sold for less than €1000

Don't create unfair competition with the therapists listed on the site. Mention the Manuela Shala method on your social media channels.

Do not mix and/or match other techniques with the Manuela Shala Method. Do not exploit the visibility of the Brand to sell products or services that are not attributable to the

brand Manuela Shala.

Work carried out using the Manuela Shala method must be cited with the same brand.

Under no circumstances may the results of the MS method be used to accredit other techniques or treatments.

It is strictly prohibited to offer training courses in the Manuela Shala Method or massages related to it. All therapists trained in the Manuela Shala Lymphatic Modeling Method are strictly prohibited from offering training courses in techniques or massages aimed at draining fluids and shaping the silhouette. Should such conduct be detected, we will immediately take legal action, both civil and criminal.

Art. 11 – Failure to participate in the course, late cancellations and no-shows

Payment of the confirmation fee implies full acceptance of these General Conditions of Sale and Participation.

The fee paid to confirm registration is expressly designated as a confirmation deposit, pursuant to art. 1385 of the Civil Code, and is intended to reserve the participant's place on the chosen date.

Any participant who is unable to attend the course is required to notify the organizer in writing at least 48 hours before the scheduled start time of the course.

In case of:

• failure to show up for the course without prior notification;
• notice of withdrawal or cancellation sent with less than 48 hours' notice;
• failure to participate, even partial, due to causes attributable to the participant;

The confirmation fee will be retained in full by the organizer and will not be refundable.

Failure to attend does not automatically entitle you to a refund, credit, transfer of registration to another person, or postponement of participation to a later date.

Any possibility of rescheduling the course or transferring the fee to another date must be previously authorized in writing by the organizer and will be subject to availability.

11. APPLICABLE LAW AND JURISDICTION

10.1. All provisions of these General Terms and Conditions are governed by the laws of the European Union and Italy. To resolve any doubts or questions relating to these General Terms and Conditions, the parties agree to submit to the jurisdiction of the Courts of Milan, Italy, and Budapest, Hungary, with the exception of complaints submitted by Users who fall within the legal definition of consumers, who may submit such complaints to the courts of their domicile.
